SAFA arbitration makes ruling on Durban City case

The SAFA arbitration on Monday made a ruling with regard to the Motsepe Foundation Championship case involving log leaders Durban City FC.

The KZN side finished top of the log in the second-tier league and secured promotion to the Betway Premiership as champions ahead of next season.

But their promotion was put on hold due to a pending arbitration process by SAFA. This came after Cape Town Spurs and JDR Star had lodged a protest against the eligibility of Sazi Magawana.

Both clubs claim that Magawana was not registered properly by the club after his move from Marumo Gallants.

JDR STARS AND CAPE TOWN SPURS FIGHT AGAINST PROMOTION OF KZN SIDE

JDR lodged their protest on 4 May before their league fixture against Durban City. CT Spurs, on the other hand, lodged their protest on the last day of the season when the two teams met at Athlone Stadium.

But their case was dismissed by the Premier Soccer League [PSL] Dispute Resolution Chamber [DRC]. This led to the clubs making an appeal to the SAFA arbitration. The matter sat before SAFA arbitrator Hilton Epstein SC on Friday, 30 May.

GOOD NEWS FOR DURBAN CITY AS SAFA ARBITRATION MAKE THE RULING IN THEIR FAVOUR

In a ruling seen by FARPost, which also includes an attached clearance certificate signed by Marumo Gallants chairman Sello Abram dated 30 May 2024, the appeal was dismissed with costs.

“The protests of JDR Stars and Cape Town Spurs and the charges levelled against Durban City and the player are dismissed,” reads the ruling.

“JDR Stars is to pay all costs arising from its protest against Durban City and the player, on scale C of the High Court tariff, including all the costs of the arbitration and the Arbitrator.”

Unless both clubs pursue the matter in the court of law, Durban City are officially Motsepe Foundation Championship winners for the 2024/25 season.
